Instructions on the Registration of Temporary Accommodation for Overseas Personnel

1.Applicant eligibility

overseas Chinese, residents from Hong Kong, Macao and Taiwan and foreigners, who have purchased a property in China, reside in a rented home, or stay in a dwelling provided by an organization or an individual other than a hotel.

2.Application method

the applicant or owner of the dwelling should visit the local police station to deal with the required formalities.

3.Application materials

3.1 The original copy of the applicant’s valid ID document, including his or her valid passport, Seaman's Certificate, Mainland Travel Permit for a Hong Kong or Macao Resident, Travel Pass for a Taiwan Resident to Enter or Leave the Mainland, Foreigner's Permanent Residence Card, as well as a valid certificate issued by China’s entry-exit authorities.

3.2 A copy of the original visa with a stamp (if any) showing the last entry into China (if any).3.3 Proof of residence that is under the jurisdiction of the local police station: property ownership certificate if the applicant has purchased a home by himself or herself; the lease contract if he or she lives in a rented apartment; ID documents of the home owners if the applicant only stays temporally in the home of their friends or relatives. If owner of the dwelling helps apply for the Registration of Temporary Accommodation for Overseas Personnel, he or she needs to present their valid ID documents or certificates issued by their work units.

5.Special notices

5.1 Foreign infants born in China should report to an entry-exit authority (Entry and Exit Administration of Shenzhen Municipal Public Security Bureau) and complete the required registration formalities within 60 days after their birth, and these infants must apply for a Chinese visa within 3 months after their birth. Failure to do so will result in a warning or a fine up to 2,000 yuan, as stipulated in the provisions of Item 1, Article 76 of the Exit and Entry Administration Law of the People’s Republic of China.

5.2 In the event of any change to the registered information, including name, sex, date of birth, purpose of residence, duration of stay, issuing date and place, residential address, passport number or number of other international travel documents, the concerned applicant should report to local police station and inform police authority of these changes within 10 days after the changes; failure to do so result in a warning or a fine up to 2,000 yuan, as stipulated in the provisions of Item 1, Article 76 of the Exit and Entry Administration Law of the People’s Republic of China.

5.3 An overseas personnel staying in a fully-licensed sauna club, with the accommodation facilities, is not required to report to local police station.

5.4 The legal liability for the owner of the dwelling: the regulations concerning the accommodation registration as stipulated in the Shenzhen Special Economic Zone Residence Permit Ordinance will stay effective for foreigners, residents from Hong Kong, Macao SAR and Taiwan who want to stay in Shenzhen. And in particular according to the Article 12, a landlord who has leased the property with the tenancy term that is not based on number of hours or days, a manager of the property or an employment unit providing accommodation for its staff members, shoulders the duty of declaration and should report to local police station for the required accommodation registration formalities within 7 days after the move-in and move-out of these non-Shenzhen-local residents.

When renting accommodation from the principal tenant, non-Shenzhen-locals should provide the accurate and complete accommodation registration information as well as their valid ID documents; and the principal tenant should provide the detailed accommodation registration information for those non-Shenzhen-locals to the landlord or the actual manager of the property, within 3 days after the move-in and move-out of these non-Shenzhen-locals.

In line with the requirements as stipulated in Article 14 and Item 2, Article 12 of the above-mentioned Ordinance, the public security organ shall order a correction and impose a fine of 500 yuan if a non-local tenant fails to provide the required accommodation registration information or makes false information to the principal tenant or actual manager of the property. If the principal tenant has violated the rules as stipulated in the Item 2, Article 12 of the above-mentioned Ordinance, failing to provide the required accommodation registration information or makes false information to the landlord or actual manager of the property, the public security organ shall order a correction and impose a fine of 500 yuan per tenant. Any employment unit or individual who has violated the rules as stipulated in the Item 2, Article 15 of the above-mentioned Ordinance, refusing to cooperate with public security authorities or a rental housing management organization that has been appointed by the public security authorities in carrying out a ransom check on the accommodation registration status for non-local residents, the public security organ shall order a correction and impose a fine of 1,000 yuan.

5.5 Records of violation of laws will affect the applicant’s application for entry-exit certificate and residence permit for staying in China.
